A fight between Oreo and Aldi wasn’t exactly on my 2025 Bingo List, but here we are. Mondelez International, the maker of Oreos, Chips Ahoy, and other beloved cookies and crackers, is suing Aldi, alleging that the supermarket chain’s store-brand cookies and crackers are “blatant copies” of Mondelez products.
The lawsuit, filed on May 27 in an Illinois federal court, claims that Aldi’s packaging and product designs are “likely to deceive and confuse consumers” and “dilute the distinctive quality” of Mondelez’s iconic product packaging, according to USA TODAY.
Mondelez argues that Aldi has a “pattern and practice of selling products in packaging that are unacceptable copies” of its own. The company says it has contacted Aldi several times about the “confusingly similar packaging” and requested that the supermarket chain stop its “unlawful infringement.” Although Aldi has made changes to the packaging of some products, the lawsuit alleges that it continues to sell other items with similar designs, as reported by The Associated Press.
Currently, Mondelez is seeking monetary damages, as well as a court order to prevent Aldi from continuing the alleged infringement. The case is still ongoing, and a resolution has yet to be reached.
This isn’t Aldi’s first legal battle over packaging. Earlier this year, the chain was in hot water when its cloudy lemon cider was found to have infringed on Thatchers’ Cider’s trademark, per BBC News. And back at the end of 2024, according to Yahoo News, Aldi was found guilty of copying products from Hampden Holdings, further complicating its legal track record.
So far, Aldi has yet to make an official statement regarding the lawsuit. We’ll keep you posted with any updates, but for now, it’s all about the courtroom drama between Oreo and Aldi.
