’Tis the year of the class action lawsuit. We’re not even three months into 2026, and we’ve already seen numerous big-name brands getting sued for everything from false advertising to price-fixing schemes, including Costco, Starbucks, David Protein, and PepsiCo. Now, KIND is the latest brand to face legal action.
A new class action lawsuit alleges that the company misled consumers by failing to disclose that its KIND Healthy Grains Dark Chocolate Clusters contain a substantial amount of lead. According to independent scientific testing commissioned by plaintiff Jade Burnett’s counsel, KIND’s granola clusters contain more than four times the California Proposition 65 Maximum Allowable Dose Level (MADL) for reproductive toxicity of lead per day (which is 0.5 micrograms).
According to the State of California’s Office of Environmental Health Hazard Assessment, the MADLs listed for lead are “Formally Required to Be Labeled or Identified” as anything higher than 0.5 micrograms per day is known to cause developmental toxicity, male reproductive toxicity, and female reproductive toxicity.
The lawsuit maintains that the presence of lead was not disclosed anywhere on the labels; it further argues that consumers would not purchase the product or pay a premium if they knew it contained lead, especially at the levels found in testing.
The suit claims that KIND misled consumers by marketing its granola as containing both “super grains” and “healthy grains,” without disclosing the product’s lead content. The lawsuit accuses KIND of unlawful business acts and practices, deceptive advertising, breach of express warranty, and unjust enrichment. It also asserts that KIND violates California’s Consumers’ Legal Remedies Act.
The class action suit seeks to represent consumers who purchased KIND Healthy Grains Dark Chocolate Clusters within the past four years and demands a jury trial, injunctive and declaratory relief, as well as compensatory and monetary damages.
At the time of publishing, KIND has not responded to a request for comment.
