It&#8217;s native to Mexico and made from Blue Weber agave. By law, tequila must contain a minimum of 51% blue agave, but higher-quality bottles are labeled 100%. This claim is at the center of a new class action lawsuit alleging Costco falsely advertises its Kirkland Signature tequila as made from 100% blue agave, when it allegedly contains ethanol from other sources.  <\/p>\n<p data-journey-content=\"true\" data-node-id=\"3\" class=\"css-6wxqfj emevuu60\">&#8220;Plaintiff and others similarly situated paid premium prices for the Products in reliance on Defendant\u2019s representations that the Products were created from 100% Blue Weber agave,\u201d the lawsuit states. Plaintiff Ariel Glazer  argues that Costco&#8217;s bottles, labeled &#8220;100% blue agave,&#8221; violate laws in both Mexico and the United States. <\/p>\n<p data-journey-content=\"true\" data-node-id=\"4\" class=\"css-6wxqfj emevuu60\">Costco sells three Kirkland Signature tequilas\u2014Blanco, Reposado, and A\u00f1ejo\u2014which typically range from $18 to $31 and are currently listed as unavailable on Costco\u2019s website. Because the labels claim 100% blue agave, the lawsuit alleges customers paid premium pricing for what they believed was a pure, high-quality product: \u201cIf Plaintiff and others similarly situated had known the truth of the ingredients in the Products, they would not have purchased the Products or would have paid less for them,\u201d the filing states. <\/p>\n<section data-embed=\"watch-next\" data-lazy-id=\"P0-13\" data-node-id=\"5\" class=\"embed\"\/>\n<section data-embed=\"editorial-link\" data-lazy-id=\"P0-14\" data-node-id=\"6\" class=\"embed\">\n<aside class=\"css-1fm2v8u e94w1mj9\">\n<h6 class=\"css-18s47pf e94w1mj7\"><span aria-hidden=\"true\" data-theme-key=\"title-design-element-before\" class=\"css-0 eagam8p0\"\/><span class=\"css-8lle59 e94w1mj5\">Related Story<\/span><span aria-hidden=\"true\" data-theme-key=\"title-design-element-after\" class=\"css-0 eagam8p1\"\/><\/h6>\n<\/aside>\n<\/section>\n<p data-journey-content=\"true\" data-node-id=\"7\" class=\"css-6wxqfj emevuu60\">According to the complaint, Nuclear Magnetic Resonance (NMR) testing\u2014used to determine if a tequila has been mixed with corn or cane alcohol\u2014indicated that Kirkland Signature A\u00f1ejo Cristalino had so much cane sugar that it wouldn&#8217;t actually qualify as tequila. The suit further claims all Kirkland Signature tequilas are made from the same base spirit, so these results can be applied to all of the brand&#8217;s tequilas, not just the A\u00f1ejo.   <\/p>\n<p data-journey-content=\"true\" data-node-id=\"8\" class=\"css-6wxqfj emevuu60\">The suit accuses Costco of negligence, negligent misrepresentation, unjust enrichment, and violating Florida&#8217;s Deceptive and Unfair Trade Practices Act (the state in which the lawsuit was filed).
